Welcome to Local To Utah. These Terms & Conditions govern access to and use of the Local To Utah website, related services, applications, content, submissions, and features, including without limitation business listings, events, articles, reviews, account features, claim requests, communication tools, and any associated public or administrative interfaces.
By accessing, browsing, creating an account, submitting content, claiming a listing, purchasing promotional placement, communicating with Local To Utah, or otherwise using the platform, each user agrees to be bound by these Terms & Conditions, the Privacy Policy, and the Editorial Standards, as each may be updated from time to time. If a user does not agree to these terms, that user must not access or use the platform.
These Terms & Conditions apply to all users of the platform, including without limitation casual visitors, readers, directory users, event browsers, businesses, advertisers, sponsors, contributors, account holders, claimants, reviewers, and any person or entity submitting material to the platform.
Eligibility and Use of the Platform
Users may access Local To Utah solely for lawful purposes and in accordance with these Terms & Conditions. Users may browse the site without creating an account, but certain features may require registration, verification, or approval. By using the platform, each user represents that any information submitted is truthful, current, complete, and not misleading.
Users who are not businesses and who use the platform only to browse listings, read articles, search events, submit reviews, contact listed businesses, or otherwise interact with public-facing content remain subject to these Terms & Conditions. Non-business users may not misuse the platform, interfere with its operation, impersonate others, submit unlawful or deceptive information, harvest data, scrape content, attempt unauthorized access, or use the site in any manner that could damage Local To Utah, listed businesses, or other users.
Accounts, Claims, and Submissions
Certain features of the platform may permit or require account registration, claim submissions, listing management, review submissions, event submissions, article submissions, or other forms of content contribution. Users are solely responsible for maintaining the confidentiality of account credentials and for all activity occurring under their accounts.
If a user submits a business claim, ownership request, review, event, article, listing, media file, or other material, that user represents and warrants that the submission is accurate, lawful, authorized, non-infringing, and compliant with all applicable laws and platform policies.
Local To Utah may accept, reject, request revisions to, suspend, revoke, or remove any submission, claim, account, or related content at its sole discretion.
Approval of a claim, publication of a listing, or publication of any content does not constitute verification of all submitted facts and does not create any obligation for Local To Utah to continue publishing, displaying, ranking, linking to, or maintaining that content in any particular form.
Content Standards and Editorial Control
Local To Utah operates as a moderated local business directory, event platform, and editorial publishing platform. All content submitted to the platform is subject to editorial review, formatting, moderation, and policy compliance. Local To Utah reserves the absolute right, but not the obligation, to edit, revise, shorten, expand, retitle, reformat, relabel, noindex, remove, decline, suspend, merge, or otherwise moderate any listing, article, event, review, link, account, image, schema markup, metadata, or other submitted material.
This editorial discretion applies whether content is submitted by a business, a contributor, a sponsor, a claimant, or a non-business user. Local To Utah may determine, in its sole discretion, whether content is appropriate, sufficiently useful, relevant to local audiences, compliant with quality standards, or suitable for publication.
Links, Promotions, and No Guarantee of Ranking Benefit
The platform may permit business listings, event pages, articles, and other content to contain links to third-party websites. The inclusion, formatting, visibility, quantity, position, anchor text, or attribute treatment of any link is determined by Local To Utah in its sole discretion.
Local To Utah may, where it deems appropriate, apply or modify link attributes including but not limited to follow, nofollow, sponsored, ugc, redirects, or other technical treatments. No user, business, advertiser, or contributor is entitled to demand a specific number of links, a specific anchor text treatment, a specific placement, or a guaranteed follow-link treatment as a condition of publication, payment, or ongoing participation.
Publication on the platform may provide visibility, branding, referral traffic, business exposure, or other indirect commercial benefits. However, Local To Utah does not guarantee search engine rankings, indexing, click-through rates, lead generation, referral traffic, answer-engine visibility, rich results, link equity, revenue, or any specific SEO outcome.
Restricted Industries and Prohibited Subject Matter
Local To Utah reserves the right to refuse, reject, suspend, remove, or prohibit any account, listing, event, article, review, claim, submission, advertisement, or other content associated with industries, services, topics, or subject matter that it determines, in its sole discretion, to be inappropriate for the platform.
Without limitation, Local To Utah does not permit listings, events, articles, promotional content, or other submissions relating to or primarily promoting:
- adult entertainment;
- escort services or prostitution-related services;
- strip clubs or sexually explicit businesses;
- pornography, erotic content, or sexually explicit materials;
- political campaigns, electioneering, partisan political advocacy, or candidate promotion;
- gambling, betting, casino promotion, sports wagering, lottery promotion, or substantially similar gambling-related activity;
- marijuana, cannabis, weed, or related commercial promotion;
- illegal drugs, drug paraphernalia, or unlawful controlled-substance activity;
- fraud, hacking, fake documents, deceptive schemes, or unlawful evasive services; or
- any substantially similar business, service, or subject matter that Local To Utah determines to be incompatible with the platform, its audience, its editorial standards, or its business model.
Local To Utah may allow certain lawful, regulated local businesses or event submissions, including for example firearms retailers, gunsmiths, sporting goods businesses, hunting-related businesses, or fireworks sellers, provided that such businesses or events are lawful in the applicable jurisdiction, accurately described, and otherwise compliant with these Terms & Conditions, the Privacy Policy, the Editorial Standards, and all applicable laws and regulations.
However, Local To Utah does not permit content, listings, events, or promotions relating to:
- illegal weapons, illegal firearm sales, or unlawful transfer activity;
- explosives, destructive devices, or dangerous materials promoted unlawfully, irresponsibly, or outside applicable law;
- instructions, promotions, or offers involving unlawful harm, violence, evasion of legal requirements, or unsafe use of regulated products; or
- any business, event, article, or submission that Local To Utah determines, in its sole discretion, creates excessive legal, safety, reputational, or policy risk.
Local To Utah may apply heightened review, request additional verification, restrict publication, or refuse publication for any regulated industry category.
Prohibited Conduct
Users may not use the platform for any unlawful, fraudulent, deceptive, abusive, defamatory, infringing, manipulative, or harmful purpose. Without limitation, prohibited conduct includes:
- submitting false, duplicated, fabricated, or misleading business, event, or article information;
- impersonating another person or entity;
- posting content primarily intended to manipulate rankings, local relevance, or link signals;
- submitting copied, scraped, spun, mass-produced, or low-value content;
- attempting to access restricted systems or accounts without authorization;
- scraping, harvesting, exporting, or bulk copying data from the platform;
- submitting malware, harmful code, or disruptive technical behavior;
- interfering with the experience, reputation, or safety of the platform, its users, or listed businesses.
Local To Utah may investigate suspected violations and may remove content, suspend access, reject claims, restrict accounts, modify link treatment, or take other action it deems appropriate.
Intellectual Property and Content License
All rights, title, and interest in and to the platform, including its design, branding, text, arrangement, software, interface elements, graphics, and proprietary content, are owned by Local To Utah and/or its licensors, except as otherwise stated.
By submitting content to the platform, the submitting party grants Local To Utah a non-exclusive, worldwide, royalty-free, sublicensable right to host, use, display, reproduce, adapt, publish, distribute, format, store, edit, moderate, and remove that content in connection with operation, promotion, administration, and improvement of the platform. This license continues for so long as reasonably necessary for those purposes, subject to removal or discontinuation at Local To Utah's discretion.
Third-Party Content and External Sites
The platform may contain third-party content, external links, user-submitted materials, and business information that is not independently verified in all cases. Local To Utah does not control and is not responsible for the content, practices, availability, policies, or conduct of third-party websites, services, businesses, or advertisers.
Any reliance on business listings, events, articles, links, reviews, or other public-facing information is at the user's own risk. Users should independently verify material facts before relying on any listing, offer, event, or representation.
Privacy
Use of the platform is also governed by the Privacy Policy, which describes how information may be collected, used, stored, disclosed, and managed. By using the platform, users acknowledge and agree to the data practices described in the Privacy Policy.
Disclaimer of Warranties
The platform is provided on an "as is," "as available," and "with all faults" basis. To the fullest extent permitted by applicable law, Local To Utah disclaims all warranties, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, data accuracy, content accuracy, security, and performance.
Limitation of Liability
To the fullest extent permitted by law, Local To Utah and its owners, operators, affiliates, licensors, contractors, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, reputational, traffic-related, ranking-related, or revenue-related damages arising out of or relating to use of, inability to use, or reliance on the platform, even if advised of the possibility of such damages.
In all events, the total aggregate liability of Local To Utah arising from or relating to the platform shall not exceed the greater of one hundred U.S. dollars (US $100) or the amount actually paid by the user to Local To Utah, if any, in the twelve months preceding the event giving rise to the claim.
Indemnification
Each user agrees to defend, indemnify, and hold harmless Local To Utah and its owners, operators, affiliates, contractors, and representatives from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to that user's content, conduct, submissions, use of the platform, violation of these Terms & Conditions, or infringement of any third-party rights.
Changes to the Platform and Terms
Local To Utah may modify, suspend, discontinue, or update any aspect of the platform, including features, pricing, routing, publication workflows, moderation policies, technical implementation, metadata, schema markup, and account functionality, at any time and without liability.
Local To Utah may also revise these Terms & Conditions from time to time. Continued use of the platform following the posting of revised terms constitutes acceptance of those revisions.
Governing Law and Contact
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles. Any disputes arising out of or relating to these terms or the platform shall be subject to the applicable courts located in Utah, unless otherwise required by law.
